Depois de receber por anos o benefício do INSS em dobro, 79 mil aposentados e pensionistas foram avisados que o Instituto Nacional do Seguro Social havia errado a conta. Desde dezembro de 2009, o erro foi corrigido e os segurados viram sua renda cair pela metade. Agora, eles terão de devolver o dinheiro extra ao governo, em parcelas que podem chegar a 30% do valor do benefício mensal.
O INSS começou a enviar cartas para informar os segurados sobre o problema. Ao recebê-las, aposentados e pensionistas terão até dez dias para entrar em contato com uma agência do Instituto e contestar a decisão. Caso a defesa não seja aceita, o segurado terá mais 30 dias para apresentar recurso. Encerrado o prazo, a única instância a que será possível recorrer é a Justiça.
O Ministério da Previdência Social não soube informar ao certo quando toda a confusão começou, mas confirma que os pagamentos extras eram feitos há mais de cinco anos. O problema, entretanto, só foi detectado em 2008 — e pelo Tribunal de Contas da União (TCU). Tratava-se da duplicação dos vínculos empregatícios, uma falha do sistema do INSS que acabou por dar a aposentados e pensionistas, todo mês, um salário a mais do que eles tinham direito.
Descoberto o problema e interrompidos os pagamentos irregulares, o INSS agora se apoia na Lei 8.213/1991 para receber o dinheiro de volta. O Instituto pretende descontar os valores da própria folha de pagamento do segurado, mas espera autorização da Advocacia Geral da União para executar a dívida. O desconto, que tem amparo legal, não deve ultrapassar 30% do benefício mensal.
“O INSS tem o direito de fazer isso, ainda que o erro no cálculo tenha sido do próprio Instituto e que o aposentado ou pensionista não tenha agido de má fé ao receber o pagamento adicional”, explica a advogada Cristiane Haik, especialista em Direito Previdenciário do escritório Pompeu, Longo, Kignel e Cipullo. “É possível até que o INSS faça a cobrança mesmo que outra parte da renda do segurado já esteja comprometida com o crédito consignado, por exemplo.” Mais de 10 milhões de contratos de empréstimos consignados foram assinados apenas em 2010 (leia mais ao lado).
Ressarcimento
Mas dos 79 mil segurados que receberam benefício em dobro por erro do INSS — em São Paulo, foram ao menos 25 mil-, nem todos terão de ressarcir o governo. Para os 15 mil que receberam o dinheiro extra até 2005, o processo já prescreveu -no Direito Previdenciário, cinco anos é o tempo máximo que a parte lesada tem para se pronunciar. Outros 51 mil só terão de devolver parte do dinheiro recebido (aqueles que ganharam a partir de 2005). E 13 mil terão de ressarcir o governo integralmente (veja quadro).
João Batista Inocentini, presidente do Sindicato Nacional dos Aposentados, informa que o erro não é muito comum. “Quando o INSS erra cálculo, é sempre para menos. Dificilmente paga mais do que deveria”, afirma. “Mas o aposentado que tiver alguma dúvida sobre a conta feita pelo governo ou quiser orientação pode procurar o sindicato”, explica ele.
A advogada Aline Mattos dos Reis, especialista em Direito Previdenciário, afirma ainda que os segurados que forem à Justiça têm chances de conseguir um parecer favorável. A remuneração paga pela Previdência tem caráter alimentar — ou seja, tem como função atender às necessidades básicas do cidadão.
“Por isso, em outros casos semelhantes, a Justiça deu ganho de causa para o aposentado, que não teria como devolver o dinheiro”, conta Aline. “Já há uma jurisprudência sobre o assunto.”
Mas só se torna necessário entrar na Justiça caso o INSS negue a defesa que o aposentado ou pensionista apresentar para se eximir do pagamento. Por enquanto, o Instituto ainda não pode começar a fazer os descontos.
